ViaSanto App Terms of Service

Last updated: 15 October 2026 · Version: 1.0

I. General provisions

  1. These Terms of Service set out the rules for the provision of services by electronic means in the ViaSanto app, in its mobile version and in its Web Version, and constitute the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services. These Terms of Service are also the Application’s Terms of Use.
  2. The publisher of the Application and the Service Provider is Marcelina Goździewska-Ćwirlej, running a sole proprietorship under the business name “ViaSanto Marcelina Goździewska-Ćwirlej”, ul. Sikorskiego 15/8, 64-920 Piła, Poland, NIP (tax ID) 7642700903 (the “Service Provider”).
  3. The Service Provider can be contacted at contact@viasanto.com in all matters, including purchases, complaints, reports of abuse and personal data protection. This address is also the point of contact for Users and for the authorities of the Member States, the European Commission and the European Board for Digital Services within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 (the Digital Services Act, “DSA”). Correspondence may be conducted in Polish, English or Spanish.
  4. The Application is intended for persons who are at least 16 years old; it is not intended for children. By accepting these Terms of Service, the User confirms that they meet this requirement.
  5. The following are part of these Terms of Service: the Purchase and Subscription Terms, the Privacy Policy and the Cookie Policy. The procedure for deleting an Account is described in the Account Deletion document.

II. Definitions

The terms defined below have the same meaning in these Terms of Service and in all the documents listed in section I.5, and are written in them with a capital letter. Labels shown on the Application’s screens are given in quotation marks, exactly as they appear in the Application.

  • Application — the ViaSanto app for iOS and Android devices and its Web Version.
  • Web Version — the Application run in a web browser. Purchases cannot be made in the Web Version, and the limitations of the free version do not apply there.
  • Service Provider — the entity identified in section I.2.
  • User — a person who is at least 16 years old and uses the Application, whether with an Account or in Guest Mode.
  • Account — the User’s account in the Application, created with an email address and password or with the “Sign in with Apple” or “Sign in with Google” button.
  • Guest Mode — using the Application without an Account. Progress is saved only on the device and is deleted from it after 24 hours.
  • Username (nickname) — the name under which the User is visible to other Users (in the Application: “Username”, “Choose your nickname”).
  • Subscription, ViaSanto Premium (Premium) — paid, automatically renewing access to the features described in the Purchase and Subscription Terms, purchased for a month or for a year.
  • Launch Offer — a time-limited, one-time promotional price for the first year of the annual Subscription for new subscribers.
  • Diamonds (💎) — internal units of the Application. They are received free of charge for prayer (one Diamond for each day of prayer), as part of the Subscription, or purchased in Diamond Packs. They are spent on Rosary Designs in the Collection. The Service Provider may in the future make other ways of using Diamonds available; information about them will appear in the Application.
  • Diamond Pack — a one-time purchase of a set number of Diamonds.
  • Prayer Points — free points, shown in the Application with a hands icon (“Points (hands)”), awarded for every prayer said and for every completed Prayer Goal. They also count towards the score of the Prayer Group and the Community to which the User belongs. They are not Diamonds and cannot be bought or exchanged for Diamonds or money.
  • Level — the designation of a member of a Prayer Group or Community: “Newcomer”, “Member” or “Veteran”, depending on the Prayer Points collected and on activity. Some limits depend on the Level, e.g. the number of Communities one may belong to and the number of Posts one may publish per hour.
  • Rosary in its Traditional Form — the Holy Rosary prayed in the traditional way, available free of charge (in the “Rosaries & novenas” menu: “Dominican Rosary (classic)”; as a Prayer Goal: “Rosary”).
  • Prayer Goal — a prayer commitment the User sets for themselves (in the Application: “Goal”): the chosen devotion, the number of days and a reminder.
  • Streak (days of prayer) — the number of consecutive days of prayer (in the Application: “Streak”, sun icon). A day without prayer starts the count again.
  • Collection — the tab of the Application marked with a book icon, containing Rosary Designs (the “ROSARIES” section), saint cards and a gallery.
  • Rosary Design — the appearance of the rosary in the Application (beads, cross, chain), unlocked with Diamonds in the Collection.
  • Draws — free rewards for prayer granted in the “Card draw” (a reward for prayer) and in the “Golden draw” (a bonus for completing a Prayer Goal). A Draw may give a saint card, a bead of a Rosary Design (a full set of beads unlocks the whole Rosary Design) or a Diamond.
  • Intention — a matter the User entrusts to God in prayer or for which they ask others to pray.
  • “My intentions” — the User’s personal list of Intentions: their own and those they have joined. Every bead prayed counts for every Intention on the list. In the free version the list holds one Intention, with Premium up to five; the Intention of the Prayer Group the User belongs to is on the list in addition.
  • Community Intention — an Intention submitted by the User for the shared prayer of other Users (the “ADD YOUR OWN INTENTION” button in the “Intentions” tab, marked with a hands icon). Submitting a Community Intention requires Premium; praying for the Intentions of other Users is free.
  • Community — a community of Users in the Application, with a chat divided into Channels and with Posts. The ViaSanto Community is the Service Provider’s official Community, which any User may join free of charge.
  • Prayer Group (Group) — a community of Users who pray together for a common Intention, with a chat divided into Channels and with Posts. The Prayer Points of the Group’s members make up its score. The ViaSanto Prayer Group is the Service Provider’s official Group, which any User may join free of charge.
  • Channel — a separate, topic-based part of the chat of a Community or Prayer Group.
  • Post, Comment, Reaction, Message — the forms of publishing content in Communities and Prayer Groups: respectively an entry, a reply under an entry, a reaction to an entry and a chat contribution.
  • Founder, Moderator — the Founder is the User who founded a Community or Prayer Group; a Moderator is a User entrusted with keeping order in it. Each of them may remove content and members.
  • ViaSanto Assistant — the automated chat Moderator, labelled in the Application as a “bot” (section VI.6(d)).
  • User Content — everything the User publishes in the Application: Intentions, Posts, Comments, Reactions, Messages, photos, videos and profile description.
  • Grace Period (30 days) — the 30 days from the request to delete an Account during which the request can be cancelled (section VII.2).

III. Subject and scope of the services

  1. ViaSanto is a Catholic prayer app. Among other things, it allows Users to pray the Holy Rosary, chaplets and novenas, to read and meditate on Sacred Scripture and the daily liturgical readings, to entrust Intentions to God and pray for the Intentions of other Users, to set Prayer Goals and grow in perseverance in prayer, and to belong to Communities and Prayer Groups.
  2. Diamonds can be received free of charge for prayer, as part of the Subscription, or purchased in Diamond Packs. They are used to unlock Rosary Designs in the Collection. The Service Provider may in the future make other ways of using Diamonds available; information about them will appear in the Application. Diamonds are not money or a means of payment, have no monetary value and cannot be exchanged for money, refunded in cash or transferred to another Account.
  3. Prayer Points are awarded free of charge only. They cannot be bought or exchanged for Diamonds or money.
  4. The Draws in the Application (“Card draw” and “Golden draw”) are solely a free reward for prayer. Draws and their results cannot be bought, neither with money nor with Diamonds. The Application offers no paid random items.
  5. Some features of the Application are free, and some are available as part of the paid, automatically renewing Subscription. The Subscription renews at the regular price in effect at the time of renewal; the promotional price of the Launch Offer applies once only, to the first year. The scope of the free version and of Premium, prices, payment, renewal and cancellation of the Subscription, the right of withdrawal and refunds are set out in the Purchase and Subscription Terms.
  6. Purchases in the Application are made exclusively through the store from which the Application was downloaded: the App Store run by Apple (on iOS devices) or Google Play run by Google (on Android devices). Payment is collected and settled by the store operator under its own terms. Purchases are not available in the Web Version.

IV. Technical requirements

  1. Using the Application requires an iOS or Android device on which the Application can be installed from the App Store or Google Play, or a web browser with JavaScript enabled (Web Version), as well as internet access. Some features, e.g. prayers and readings already saved on the device, also work offline.
  2. Creating an Account requires an active email address or an Apple or Google account.

V. Account and sign-in

  1. The full range of the Application’s features, including the community features, is available once an Account has been created. An Account is also needed for purchases (Diamonds and the Subscription): purchases are linked to the Account and available on every device on which the User signs in to it.
  2. An Account is created and signed in to with an email address and password, or with the “Sign in with Apple” or “Sign in with Google” button.
  3. The Application can also be used in Guest Mode, without creating an Account. Progress is then saved only on the device and kept for 24 hours, after which it is deleted from the device. Community features and purchases are not available in Guest Mode. Creating a free Account is sufficient to keep the progress.
  4. The User must protect access to their Account.

VI. User Content, community rules and moderation (DSA)

  1. Users can publish User Content in the Application, such as Intentions, Posts, Comments, Reactions, photos and videos, and Messages in the chats of Communities and Prayer Groups.
  2. The User who published User Content is solely responsible for it. It is prohibited to publish content that is: unlawful; offensive, vulgar, obscene or pornographic; depicting or promoting violence; inciting hatred or discriminatory (including on grounds of origin, nationality, religion, sex, sexual orientation or disability); harassment, intimidation, threats or bullying of other persons; infringing other persons’ personal rights, privacy or copyright (including disclosing other people’s personal data); misleading, fraudulent or impersonating other persons; advertising or spam (including links).
  3. Zero tolerance. The Service Provider does not tolerate prohibited content or Users who use the Application to harm others. Such content is removed, and the Accounts of those who publish it may be blocked or deleted.
  4. Intentions concerning other people. A User who entrusts an Intention concerning another person, especially an Intention containing information about that person’s health, does not give details that would allow that person to be identified, such as their full name. The exception is where that person has expressly agreed to it. The first name alone, or a description of who the person is to the User, is sufficient, for example: “for my sick mother”, “for a friend who is having surgery”.
  5. The User grants the Service Provider a non-exclusive, royalty-free licence to display the published User Content in the Application for as long as it remains published.
  6. User protection tools. The Application provides:
    • (a) the “Report” button on Posts, Comments and Messages; the report goes to the Moderators and to the Service Provider. An Intention can be reported by email to contact@viasanto.com (section VI.8);
    • (b) the “Block user” button on the profile card and in the Message menu; the blocked User’s content is no longer visible to the person who blocked them. Unblocking is done in Settings → the “Community privacy” tab (fish icon on the bottom bar) → the “BLOCKED USERS” section;
    • (c) automatic filters: chat participants who are neither Founders nor Moderators cannot publish links to sites outside the Application, long strings of digits (e.g. bank account numbers) or content about cryptocurrencies, and no one may publish photos containing QR codes;
    • (d) the ViaSanto Assistant, the automated chat Moderator, labelled in the Application as a “bot”; its Messages are generated automatically by a system, not by a person. The ViaSanto Assistant welcomes newcomers, gives hints on where things are in the Application, moves bug reports and ideas to the proper Channels and removes Messages that break the rules (e.g. containing profanity), informing the author. It is always on in open Communities and Prayer Groups and in the ViaSanto Community and the ViaSanto Prayer Group; in others it can be switched off by the Founder or a Moderator. The ViaSanto Assistant runs on the Service Provider’s server, and the content of Messages is not passed to external providers. If an external provider (e.g. of an artificial intelligence model) is ever enabled for its operation, the Service Provider will update the Privacy Policy before that happens;
    • (e) automatic hiding of content reported by several different people, until a Moderator decides;
    • (f) Founders and Moderators of Communities and Prayer Groups, who can remove content and members.
  7. Handling reports. The Service Provider handles reports promptly, no later than within 24 hours of receipt. If content violates the law or these Terms of Service, the Service Provider removes it or restricts its visibility and, depending on the severity and recurrence of the violations, may block the publishing User’s ability to post or block or delete their Account.
  8. Reports from outside the Application (Article 16 DSA). Anyone, including persons without an Account, can report illegal content, including an Intention, by email to contact@viasanto.com, stating: an explanation of why the content is illegal; where the content is (e.g. the name of the Community, author, date, screenshot); the name and email address of the person reporting (not required for reports of child sexual abuse offences); and a statement that the report is made in good faith. The Service Provider confirms receipt of the report and informs the person reporting of the decision taken.
  9. Statement of reasons and appeal. A User whose content has been removed or whose Account has been restricted is informed of the decision and its reasons (in the Application or by email). The decision can be appealed within 6 months by sending the appeal to contact@viasanto.com; appeals are reviewed by a person, not by an automated system. The Service Provider does not use profiling or recommendations of content based on profiling. The Service Provider notifies the competent authorities of content that may indicate a threat to the life or safety of persons.

VII. Account deletion and termination

  1. The User may stop using the Application and delete their Account at any time. In the Application this is done as follows: Settings (gear icon in the top right corner of the screen) → the “Profile” tab (person icon on the bottom bar) → the “ACCOUNT” section → “Account” → the “DELETE ACCOUNT” section → “Delete account”, followed by confirmation with the “Next” and “Delete account” buttons. Deletion of the Account may also be requested by email sent from the address linked to the Account to contact@viasanto.com. Details are given in the Account Deletion document.
  2. Grace Period (30 days). Data stored on the device is deleted immediately, and data on the server after the Grace Period, which lasts 30 days from confirming “Delete account” in the Application or, for a request sent by email, from its registration by the Service Provider. During the Grace Period the User can cancel the deletion of the Account and keep their data, Diamonds and Premium by sending an email to contact@viasanto.com from the address linked to the Account; signing in is not required. Once the Grace Period has ended, the deletion is irreversible and the data is permanently deleted, except for data whose further retention is required by law or necessary to defend against claims (see the Privacy Policy).
  3. Neither deleting the Account nor uninstalling the Application cancels the Subscription in the store. To avoid further charges, the User should cancel the Subscription in the App Store or Google Play subscription settings before deleting the Account.
  4. When the Account is permanently deleted (after the Grace Period), unused Diamonds (purchased and received) and Premium access for the remaining part of the paid period are forfeited; they are not restored or refunded. This does not affect the consumer rights described in the Purchase and Subscription Terms or the store’s refund rules.
  5. The Service Provider may terminate the agreement with the User and delete their Account in the event of a gross or persistent breach of these Terms of Service, in particular section VI, after informing the User of the reason in advance, unless the safety of other Users or the law requires action without prior notice.
  6. In the event of abuse related to purchases, in particular repeated refund requests after the Diamonds have been used, the Service Provider may suspend the Account or restrict the ability to make purchases with it (see the Purchase and Subscription Terms, section 8).

VIII. Licence, App Store and Google Play

  1. The Service Provider grants the User a non-exclusive, non-transferable, revocable licence to use the Application solely for personal, non-commercial purposes, on devices the User owns or controls, in accordance with these Terms of Service and the rules of the store from which the Application was downloaded.
  2. An Application downloaded from the App Store is also subject to Apple’s standard end user licence agreement (Licensed Application End User License Agreement). The agreement regarding the Application is concluded solely between the User and the Service Provider, not with Apple Inc. The Service Provider, not Apple, is responsible for the Application and its content, its maintenance and technical support, and for handling any claims relating to the Application (including claims concerning legal compliance, consumer protection and third-party intellectual property rights). Apple has no obligation to provide maintenance or support services for the Application. If the Application fails to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price of the Application (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application. The User represents that they are not located in a country subject to a US Government embargo and are not listed on any US Government list of prohibited or restricted parties. Apple Inc. and its subsidiaries are third-party beneficiaries of these provisions and, upon the User’s acceptance, may enforce them against the User as third parties.
  3. An Application downloaded from Google Play is also subject to the Google Play Terms of Service. Google is not a party to the agreement regarding the Application.
  4. Sections VIII.1–VIII.3 do not limit the rights that consumers have by law and that cannot be excluded by contract, including rights where digital content does not conform to the contract.

IX. Copyright

  1. The copyright in the Application, including its software and graphic design, belongs to the Service Provider or to persons who have granted the Service Provider a licence for it. The texts of Sacred Scripture in older translations, such as the Bible of Fr. Jakub Wujek or the Vulgate, are in the public domain and are made available in accordance with that status.

X. Complaints

  1. Complaints about the operation of the Application, including incorrect delivery of Diamonds or Premium access, may be sent to the Service Provider’s email address: contact@viasanto.com. The Service Provider handles them within 14 days. Refunds for purchases in the Application are handled by the store operator (App Store or Google Play); details are set out in the Purchase and Subscription Terms.
  2. A consumer may use out-of-court complaint and redress procedures, in particular the assistance of a municipal or district consumer ombudsman, a provincial inspectorate of the Trade Inspection or, in cross-border disputes within the European Union, the European Consumer Centre.

XI. Changes to the Terms of Service and final provisions

  1. The Service Provider may amend these Terms of Service for important reasons, in particular changes in the law, changes in the scope or manner of providing the services, or security reasons. The User will be informed of the change in the Application at least 14 days before it takes effect. A User who does not accept the changes may delete their Account at any time.
  2. These Terms of Service are governed by Polish law. A consumer living outside Poland keeps the protection given to them by the laws of their country of residence.
  3. These Terms of Service are available in Polish, English and Spanish. The Polish version is binding.
